Frequently when an employee is disabled and requests either an accommodation by way of a leave or changes in their work
structure, there is a response by the employer.
What we hope is that the employer employer is responding positively. They provide the accommodation. They uh work
with the employee to be able to take time off. But unfortunately sometimes what we see is that immediately after there’s a disclosure of a disability or
a request for some sort of an accommodation including a leave, things start to happen at work. They get left
out of meetings. They um do not get assignments that are complicated anymore. They fall off a track. After
years of receiving performance reviews that were positive, all of a sudden the performance reviews start to go negative. Worse yet, if an employee is
on a leave and they attempt to come back, the employer puts a fight, multiple obstacles in the way of an
employes’s ability to come back to the office. And the ultimate is when they get terminated. When the employee gets
terminated after they attempt to return from a leave of absence. Those are the factors
that we look at to see what happened after a disclosure of a a disability or
a leave and its impact on the career of the employee. Be it a demotion, limitation on responsibilities or a termination.

Los Angeles, CA employment plaintiffs attorney Navid Yadegar talks about how to know if you’ve been the victim of disability discrimination. He describes how employers may respond when an employee with a disability requests a reasonable accommodation, such as taking medical leave or making changes to their work structure. He notes that the expected response is for the employer to work with the employee, provide the appropriate accommodation, and allow them to take necessary time away from work when warranted. Unfortunately, he points out that some employees experience negative changes in the workplace shortly after disclosing a disability or requesting an accommodation.

He explains that these changes can include being excluded from meetings, receiving fewer complex assignments, being removed from career opportunities, or suddenly receiving negative performance reviews after years of positive evaluations. He also notes that difficulties may arise when an employee attempts to return from medical leave, with employers sometimes creating obstacles that make it difficult for the employee to return to work. In the most serious situations, the employee may ultimately be terminated after attempting to return from leave.

He emphasizes that his firm examines what happens following an employee’s disclosure of a disability or request for leave and considers how those actions affect the employee’s career. This may include a demotion, reduced responsibilities, limitations on opportunities, or termination, all of which can be important factors when evaluating a potential disability discrimination or retaliation claim.
