Years ago what we’d call mental-mental claims were not compensable. If you witnessed a – let’s say a coworker get violently killed or assaulted and you developed depression or anxiety because of that, it was not compensable. Now in our state there is a mental-mental injury where you can get compensated for lost time, wage loss benefits, even medical benefits just because of a mental health injury. But there are very specific rules with regard to what type of job you did at the time and the type of injury you’ve had. So the short answer yes, but it’s very specific.

Minnesota Workers’ Comp and Social Security Disability attorney, Tom Atkinson, talks about whether or not mental health claims can be covered by workers’ comp in the state of Minnesota.
