We handle a a a good number of pedestrian accidents. Obviously, this is where a a motor vehicle will will will strike a person. Um typically walking,
pedestrian walking, and they can happen in different places. They happen in parking lots. Um they happen at intersections. Um they can happen away
from an intersection. And what the insurance companies try to do to to defend these is they try to say, “Well,
the person wasn’t in the crosswalk or the the person was crossing against the light or the person in the parking lot wasn’t watching where they’re going.”
All those are ridiculous, first of all. Okay, you one cross in the crosswalk.
Okay, be very be very careful. It’s dangerous to be to be crossing a busy intersection. Go with the light. make sure you but if the person if the person
is is is is crossing away from an intersection they’ll call it jaywalking and they try to use that against and
they will say we’re not paying anything and and I don’t take that I’ve handled lots of cases where people have been supposedly jaywalking and been struck by
a car and and my perspective is okay maybe my person shouldn’t have been crossing the road where they were crossing but they were there to be seen
why did you run into them um why were you not paying attention to make sure that you there there was not a person in the road ahead of you. Were you not paying attention? Okay. And so again,
insurance companies tried to say, “This is a complete denial. We’re not paying a penny on this case because the person was jaywalking.” And I say, “Not a
chance.” Okay? I’m going to take you to court. I’m going to file suit. I’m going to fight for this injury victim because your person should have been paying attention as to where they were going,
should have been watching, and should have avoided the pedestrian crossing the street.
Dayton Ohio, personal injury attorney Kevin Attkisson talks about how the insurance companies try to win injured pedestrian cases.
