00:03
the h-1b visa is the most common way
00:07
that foreign professionals come to the
00:09
United States to work legally the h-1b
00:12
requires an employer to sponsor the
00:14
foreign national for a specialty
00:16
occupation which means a job that
00:19
requires a specialized degree and the
00:22
foreign national has that specialized
00:24
degree the hardest part of the h-1b is
00:27
that they’re limited in number there’s
00:29
only 85,000 available every fiscal year
00:33
but the demand is in the hundreds of
00:35
thousands so the government is forced to
00:37
conduct a lottery
00:39
and pick out the 85,000 winners each
00:41
fiscal year but it turns out that
00:44
Congress decided that there are four
00:47
particular organizations that should be
00:50
exempt from the annual cap of 85,000
00:54
h-1bs government research organizations
00:57
nonprofit research organizations
01:00
universities and nonprofit organizations
01:03
that are affiliated with the university
01:06
these four organizations are exempt from
01:09
the annual cap so they can always file
01:12
an h-1b for a qualified foreign national
01:15
now what’s interesting about the law is
01:18
that the cap exempt h-1b is not only
01:22
available to those four organizations
01:25
but it is also available to any company
01:29
even a private company if the foreign
01:32
national already has received a cap
01:35
exempt organization so consider this a
01:38
company wants to hire a very valuable
01:41
foreign national let’s say it’s a
01:42
chemical engineer and they want this
01:45
particular chemical engineer but the
01:47
only solution is h-1b and there are no
01:50
h-1b visas available what does the
01:53
company do well it turns out if a
01:56
university or a non-profit affiliated
02:00
with a university will hire that foreign
02:03
national for part-time h-1b work let’s
02:06
say ten hours a week to do professional
02:10
h-1b work that truly requires about
02:13
Julis degree in a specialized field and
02:15
that employer files for a cap exempt
02:19
h-1b because they can and the US
02:21
Immigration Service approves that cap
02:23
exempt h-1b well then suddenly any
02:27
private company is able to piggyback on
02:30
top of that cap exempt h-1b and
02:33
immediately file for their own
02:35
cap-exempt h-1b even though without that
02:40
situation the same employer could never
02:42
file for a cap exempt h-1b because
02:44
they’re not one of the four designated
02:45
cap-exempt employers well this is a very
02:49
interesting solution for so many people
02:52
it’s created much discussion and
02:55
excitement among immigration attorneys
02:58
our law firm has particular expertise
03:00
with cap-exempt h-1b visas for the
03:03
following reasons I personally have
03:06
created two different cap-exempt
03:09
employment situations in 2015 I
03:12
conceived of and helped implement a
03:15
program called the Massachusetts global
03:18
entrepreneurship in residence program
03:20
which has become a wildly successful
03:24
cap-exempt h-1b program in partnership
03:27
with the University of Massachusetts
03:29
following up on the success of the
03:32
Massachusetts Global Entrepreneurship
03:34
and residence program in 2018 I started
03:39
my own nonprofit organization which is
03:42
doing terrific things to help immigrants
03:44
all over the country but I realize that
03:47
a nonprofit organization is one of the
03:51
cap-exempt h-1b organizations if it has
03:54
an affiliation with the University so
03:57
after we had established the nonprofit
03:59
we reached out to six universities here
04:04
in Massachusetts to see whether they
04:07
would be interested in some kind of an
04:09
affiliation agreement which would help
04:11
university students and it’s become a
04:14
fabulous program where foreign nationals
04:17
are now working as mentors to university
04:20
students in the STEM fields and now open
04:24
avenues foundation
04:26
is an h-1b cap exempt organization
04:29
because it is a non-profit affiliated
04:32
with universities as such open avenues
04:35
foundation is able to sponsor cap-exempt
04:38
h-1bs and businesses all over
04:40
Massachusetts in New England are
04:42
partnering with open avenues foundation
04:45
to obtain their own cap-exempt h-1bs
04:48
based on the same model that was proven
04:51
successful with the University of
04:52
Massachusetts

Cambridge, MA immigration lawyer Jeff Goldman explains how a Cap Exempt H-1 B Visa works and how his firm assists their clients in obtaining one. He remarks that the H-1B visa is the most common way for foreign professionals to come to the United States to work legally. The H-1B requires an employer to sponsor a foreign national for a specialty occupation—meaning a job that requires a specialized degree which the foreign national possesses. The challenge with H-1Bs is that they are limited in number, with only 85,000 available each fiscal year, while demand reaches into the hundreds of thousands. As a result, the government conducts a lottery to select the 85,000 recipients.

Congress, however, created exemptions from this annual cap for four types of organizations: government research organizations, nonprofit research organizations, universities, and nonprofit organizations affiliated with universities. These organizations can always file for H-1Bs for qualified foreign nationals, regardless of the cap. Interestingly, once a foreign national has received a cap-exempt H-1B through one of these organizations, any private company can “piggyback” on that cap-exempt status to file their own H-1B for that individual—even though the private company itself would not otherwise qualify as a cap-exempt employer.

This approach provides a valuable solution for companies seeking highly skilled foreign professionals when standard H-1Bs are unavailable. He notes that their law firm has particular expertise in cap-exempt H-1Bs. In 2015, he helped create the Massachusetts Global Entrepreneurship in Residence Program in partnership with the University of Massachusetts, which became a highly successful cap-exempt H-1B program. Building on that success, in 2018 he established his own nonprofit organization, which, through affiliations with six universities in Massachusetts, qualifies as a cap-exempt H-1B organization.

Through this structure, the nonprofit is able to sponsor cap-exempt H-1Bs, allowing businesses across Massachusetts and New England to obtain cap-exempt H-1Bs for foreign nationals using the proven model from the University of Massachusetts program. This innovative strategy has opened new avenues for employers and foreign professionals alike.
