So section 1983 it’s actually it’s a statutory means by which an individual can assert their constitutional rights.
so if a police officer for example has violated our our our rights through excessive force or through an illegal search and seizure that’s written in the
constitution. We have amendments in the constitution. 1983 is a statute that allows you as an individual to file a lawsuit based on the deprivation of that
statutory right and importantly it’s generally a lawsuit for money damages.
Now, states, entities, they can file constitutional claims against the government, you know, to to stop a tax from going into effect, something like
that. But without 1983, an individual who’s had their constitutional rights violated has no remedy.
