so the H-1B is like the primary
professional temporary work visa that’s
available to people who basically have a
college degree or the equivalent of a
college degree so you need to have an
employer who’s willing to sponsor you
for an H1B visa and that employer has to
you know meet certain attestations
including that they will pay the
prevailing wage for the position offered
has to be you know a position here in
the United States and they need to be a
U.S employer but as far as the for a
national goes the degree needs to be in
an area that relates to the position so
it’s referred to as a specialty
occupation but what that really means is
that someone has to be formally educated
in a way that their degree relates to
the work that has to be performed and
there needs to be a Nexus so I would say
one of the biggest challenges with h-1bs
is sometimes demonstrating to the
government which doesn’t always
understand what people do or what this
occupation necessarily entails that the
degree that the foreign National
possesses actually is required to
perform the work
