Car accidents happen due to one or more drivers being negligent. That is,
they’re doing something that a a reasonably careful person would not be doing under the circumstances such as
I’m looking at my phone. I’m texting while I’m driving. That is negligence.
sAnd if that negligence results in a collision, then we call that the the person was was driving or a distracted
driver. Okay? And there’s all different ways to be a distracted driver, but these days it seems like the cell phone is is the number one. You could be eating a hamburger, you could be doing
you can be your kids can be causing something in the back seat, and you can be distracted for any number of reasons.
And I will tell you that to the injury victim, it’s it’s interesting, but if the person is is playing with the radio
or they’re they’re they’re talking to their kids or they’re doing whatever,
they’re injured just the same. Okay? And we we we fight these cases. It’s part of the story as to what happened.
Obviously, if the person was intoxicated, that could be that could lead to other issues um such as punitive damages. But if a person is is
distracted and they cause a wreck, the person is hurt just the same way as they would be hurt if the if the person did,
you know, any other thing to cause the wreck. So we look to negligence. What caused the negligence? Did did the negligence cause a collision? And then
consequently cause somebody to be injured. That’s the key. The key is negligence causing an injury. And it can
happen for any number of reasons. And being distracted is one of many.
