Well, there’s a civil statute that says that it – that you can’t, that an employer cannot fire you for filing a workers’ compensation claim. But I have found many of my clients find themselves fired after filing a claim for some other reason, because Minnesota is an at-will employment state, and that means you can be fired at any time for any reason or for no reason at all. Frequently the employer will say, you know, that the employee violated a workplace policy by using his or her cell phone during work hours or smoking on the employer’s promises, something that frequently comes from out of the blue.

Minnesota Workers’ Comp and Social Security Disability attorney, Kerry O’Rourke Atkinson, talks about whether or not you can be fired for a work injury.
