Well, you have a work comp claim if you were injured on the job performing a duty for the employer. So for example, if you slip and fall on a public sidewalk that’s not a work comp claim, but if you slip and fall on a public sidewalk because you’re rushing to get to another appointment for your employer’s benefit, that’s a work comp claim. Or if you slip and fall on an icy sidewalk and you’re carrying a piece of equipment for your employer’s benefit, that’s a work comp claim. So you basically have to be doing your job and the injury has to happen because of the job.

Minnesota Workers’ Comp and Social Security Disability attorney, Kerry O’Rourke Atkinson, talks about how you should know if you have a workers’ comp claim.
