the biggest challenges in defending a
sex crime case
are how publicity and the public views
these they’re prosecuted by taglines
these days the metoo movement made sex
crimes very difficult to defend juries
had a certain attitude looking at them
and taking the case apart involves more
than just a tagline prosecution has
taglines and logos and whatnot it’s easy
for them to prosecute these cases and
it’s difficult to defend should a case
go to a jury it’s very difficult to find
or to to do jury selection because
jurors tend to have a lot of
pre-existing Notions about why a person
finds themselves in court charged with a
sex crime and that’s my job is to tell
the story that just because they’re in
court doesn’t mean they’re guilty
Denver, CO criminal defense attorney David Lindsey discusses the biggest challenges faced in CO sex crime cases. He explains that defending a sex crime case presents significant challenges, particularly in the context of public perception and media influence. These cases are often sensationalized, and public attitudes shaped by movements like #MeToo can make it difficult to mount a successful defense. Prosecutions tend to rely on catchy taglines and imagery, which can be powerful tools in influencing public opinion. However, dismantling a case requires going beyond these surface-level narratives. Prosecutors have the advantage of leveraging these taglines and logos, making it challenging to mount a robust defense. Furthermore, jury selection becomes a complex task, as potential jurors often come with preconceived notions about individuals accused of sex crimes. As a defense attorney, my role is to counter these biases and emphasize that being in court does not equate to guilt. It is essential to present a comprehensive narrative that provides a fair and accurate representation of the accused.
