Knowing the rules of procedure and the rules of evidence like the back of your hand is essential. Practicing trial law and litigation, in my opinion, is won or lost before you enter the courtroom, much like a sporting event. Preparation cannot be understated. You need to know your judge and research the lawyers on the other side — who your opponents are. Additionally, your lawyer must be confident, have emotional intelligence, including the ability to read and respond to others, and have the adaptability to think quickly on their feet and adjust to any arguments and strategies when necessary. They must be highly ethical, communicate well, and be able to tell the client’s story because litigation is really about competing stories.
I am a graduate of Stetson University College of Law with honors and am licensed to practice not only in Florida but also in Washington, D.C., and Texas. I am admitted to the 11th Circuit Court of Appeals, all the federal courts in the state of Florida, the International Court of Trade, the United States Supreme Court, and the United States Tax Court. After law school, I served as an Assistant State Attorney, where I prosecuted various crimes from misdemeanors to felonies. Following my time as a prosecutor, I returned to law school and earned an advanced law degree, an LLM in International Law and Business.
I have been nominated as one of Florida’s Super Lawyers from 2017 to 2023 in business litigation and recognized in Florida’s Legal Elite for commercial and business litigation. I am one of fewer than 300 lawyers in Florida who are board certified in business litigation. My background and experience in both criminal and business law make me uniquely qualified to handle cases where there may be concerns about exposure in either area.
I have taught continuing education classes to lawyers and have written on topics such as judgment enforcement, post-judgment proceedings, types of damages in business litigation cases, handling business divorce, drafting covenants, representations and warranties in contracts, the intersection of probate litigation and business litigation, and proper time billing and collections for attorneys’ fees. Additionally, I have experience handling international criminal narco-trafficking cases and have written about the perils of practicing international criminal defense. I have also authored articles on the 10 international treaties and conventions that every U.S. lawyer should know and have taught courses on evidence and the law of private placement memorandums.

Palm Harbor, FL business litigation attorney Robert D. Eckard discusses what it takes to be successful in the courtroom as well as his background & experience and his scholarly work. He emphasizes that mastery of the rules of procedure and evidence is fundamental to effective trial practice. In his view, litigation is often won or lost before ever stepping into the courtroom—much like preparing for a major sporting event. Preparation is critical, and it includes understanding the judge, researching opposing counsel, and anticipating strategies. Beyond preparation, he believes successful trial lawyers must combine confidence with emotional intelligence, the ability to read and respond to others, adaptability to adjust arguments on the spot, and strong ethical grounding. Effective communication and the ability to convey a client’s story are also central, as litigation ultimately comes down to competing narratives.
