two years to bring a bring a lawsuit from the time that they were injured, but no more than three. Okay? So, there’s a there’s a statute of repose in
Connecticut which allows you a maximum of three years from the date that they were injured. However, if your lawsuit is based on uh wrongful death medical
malpractice, you have two years from the date of death to bring a lawsuit. Again, it gets even further complicated because
that deadline can be extended by 90 days. And um there’s a look back period
of 5 years. So to be safe, anyone that has a a an injury or a wrongful death
sounding in medical malpractice, that case should be brought within 2 years from the date of discovery or the date of death.

Stamford, CT personal injury attorney Joaquin Madry talks about how long you have to bring a medical malpractice claim. He explains that when a person suffers a catastrophic injury as a result of alleged medical malpractice, Connecticut law generally provides two years from the date of the injury to file a lawsuit. He notes, however, that the state also imposes a statute of repose, which typically prevents claims from being filed more than three years after the injury occurred, regardless of when it was discovered.

He further explains that different rules apply in wrongful death medical malpractice cases. In those situations, the surviving family generally has two years from the date of death to bring a claim. He adds that the filing deadline may be extended by up to 90 days under certain circumstances and that Connecticut law also includes a five-year look-back period that can affect these cases.

According to him, because medical malpractice deadlines can be complex and involve multiple legal time limits, it is important to act promptly. He advises that, to be safe, individuals pursuing a medical malpractice injury claim or a wrongful death claim should seek legal guidance and file their case within two years of discovering the injury or from the date of death.
