so mediation is probably the most well
known and when we’re talking about adr
we often
you know default effect to mediation as
the label but officially we have a whole
bunch of other things we have financial
early neutral evaluation which is
dealing with the money issues we have
social early neutral evaluation
which is dealing with the kid issues we
have parenting consultants
we have consensual special magistrates
special masters arbitration you know
depending on what process makes the most
sense for
you know the family or for your client
you know all of these options are
available uh depending on the
circumstances so that’s kind of the the
main list we deal with but
the the law allows people to kind of
create their own process also there’s
some very creative ideas out there
and sometimes there’s certain cultural
traditions or religious practices that
are respected in different forms of adr
and so we acknowledge those and so
sometimes the you know other life
experiences inform the adr process more
than maybe a court hearing or than
traditional mediation would

He points out that while mediation is probably the most widely recognized form of alternative dispute resolution (ADR), it’s far from the only option. In addition to mediation, there are financial early neutral evaluations, which address monetary issues, and social early neutral evaluations, which focus on matters involving children. Families may also work with parenting consultants, consensual special magistrates, special masters, or even go through arbitration.

He emphasizes that the right process depends on the family’s circumstances and the client’s needs. Beyond these standard options, the law also allows parties to create their own ADR process, and he notes that some families pursue creative approaches influenced by cultural traditions or religious practices. In many cases, he adds, those personal or cultural elements can play a more meaningful role in shaping ADR than a traditional court hearing or even standard mediation might.
