First of all, the cases that I generally handle are are more complicated than most. A typical eminent domain case
might be establishing a roadway through a residential area and you have to value the houses. houses are fairly easy to
value although you know there differences between various houses but in commercial settings for example along
Wilshire Boulevard or dealing with uh industrial parks or something like that you’re going to have different issues
about highest and best use the maximum value that the property uh would go for depending upon what uses can be made of
the property whether the property is the land value is approaching the value of the improve improvements so that perhaps
anybody who buys it might say, “Hey, I’m thinking about demolishing the improvements because the land’s so valuable.” All those factors weigh into
fair market value in an eminent domain case.
