Inverse condemnation came claims can arise in a variety of situations. Number one is when a propertyy’s being
developed and the government concludes that they want to take part of the property for beach access or something
like that and prevent the property on from using that portion of the property or prevent the whole property from being
built until the property owner agrees to that access. That’s one factor that could lead to an inverse condemnation
claim. Second factor might be when the government agency decides that they don’t want to have additional uses
in that location even though it’s properly zoned because they want to hold the property for a future public project
or some other project and it prevents the property owner from proceeding with his or her plan for the property. There
are other situations where all of a sudden the government comes onto the property for some reason, i.e. to
mitigate some other damage or something like that and as a result they’re on the property using it and that can lead to a
direct condemnation case. The other ones that I talked about were called regulatory takings and those are different.
