property owner can object to the government’s right to take the property.
It generally relates to the inability, at least in California, to comply with environmental laws, but there may be
other reasons. For example, the government might have precommitted to take the property before there’s any hearing on whether to take it. And if
the government’s bound to a contract to take the property before the property owner even has a chance to object, the
courts might find that that’s basically a preconceived attempt by the government to take the property without giving the property
owner a real say in whether or not it should be taken.
