It’s giving evidence against yourself.
And whether it’s consenting to a blood draw or a breath test, doing the standardized field sobriety test on the
side of the road, or talking to the police, those I think are the three biggest uh areas where people make
mistakes after a DWI arrest. So, I think if somebody were to be arrested for DWI and not do a combination of those things
or any of those things, I think it would significantly help with their defense and with the lawyer’s ability to
successfully get through that case for them.
San Antonio, TX criminal defense attorney Daniel De La Garza talks about the biggest mistake people make after a DWI stop. He states that these actions can essentially amount to providing evidence against oneself. He notes that the most common mistakes after a DWI arrest involve consenting to a blood draw or breath test, performing standardized field sobriety tests on the roadside, or speaking with the police. He further emphasizes that avoiding these actions can significantly strengthen a person’s defense and improve a lawyer’s ability to effectively handle the case.
