If you’re questioned by law enforcement, either state or federal, ask if you’re free to leave. If so, you can leave. If you’re not free to leave, you should invoke your right to remain silent and ask for a lawyer. You should also not lie to law enforcement; if you’re going to speak, you need to speak truthfully. Stay calm, be respectful, and don’t worry about looking guilty, because it’s more important for your lawyer, for me, to keep you out of jail than worrying about how things look to law enforcement.

Palm Harbor, FL criminal defense attorney Robert D. Eckard shares his advice for people charged with a crime. He recommends that if an individual is questioned by law enforcement, whether state or federal, they should first determine if they are free to leave. If they are not, he emphasizes the importance of invoking the right to remain silent and requesting legal counsel. He stresses that one should never provide false information to law enforcement; if a statement is made, it must be truthful. He also advises remaining calm and respectful throughout the interaction, noting that concerns about appearing suspicious are secondary to ensuring the protection of one’s legal rights and avoiding unnecessary criminal exposure.
