And so it’s very important that you still um take this case very seriously and hire a good defense attorney to
fight for you. Just because um a complainant in a case signs what we often refer to as an affidavit of
non-prosecution, meaning they have signed a document telling the district attorney’s office that they don’t want
to cooperate. um or uh put press charges against you. While it helps get your case dismissed, it is not always a
guarantee. And so you need to take your case seriously and find a good uh defense attorney.

She explains that while it can help, it is not guaranteed to result in a dismissal. For that reason, it is important to take the case seriously and retain a strong defense attorney.
She notes that even if a complainant signs an affidavit of non-prosecution—stating to the district attorney’s office that they do not wish to cooperate or pursue charges—it may support a dismissal, but it does not guarantee that the case will be dropped. Accordingly, individuals should not rely on that alone and should seek experienced legal representation to properly defend the case.
