trust administration is a little bit
different than
a probate administration because uh one
we don’t have the court involved
typically when we’re dealing with a
trust administration so we still need to
notice creditors and
uh make amends with them if possible
but if there aren’t creditors it can be
a lot simpler
so sometimes we have families that come
in and they let us know
this person in our lives has passed away
where do we start and so we’ll sit down
with them as attorneys and usually
there’s some initial documents we need
to draft a certificate of trust an
affidavit of death of a trustee or joint
tenant or whatever it might be
and then we just point the the trustee
or the executor or the beneficiary
depending on what the circumstance is we
point them in the right direction and
they can handle a lot of things on their
own sometimes we have those people come
in and and they don’t want to be
hands-on so we’ll perform specific tasks
for them
but a trust administration is a much
quicker
painless process
for the most part than when we’re
dealing with a normal probate
administration
Las Vegas, NV estate planning attorney Zachary Morris explains how trust administration is different from probate administration. He explains that trust administration is somewhat different from probate administration. Unlike probate, the court typically isn’t involved in trust administration. Creditors still need to be notified and addressed if possible, but if there are no creditors, the process can be much simpler.
Often, families come in after a loved one has passed and don’t know where to start. He sits down with them and reviews the initial steps, which usually include drafting documents like a certificate of trust or an affidavit of death for a trustee or joint tenant. From there, he guides the trustee, executor, or beneficiary, depending on the situation, pointing them in the right direction so they can handle many tasks on their own.
In cases where clients prefer not to be hands-on, he and his team will perform specific tasks on their behalf. Overall, trust administration tends to be a much quicker and more straightforward process compared to a standard probate administration.
