So when a client comes to us, obviously
we have to um assess the situation to
see what their issue is. Um the first
thing I do is if there’s an attorney
involved, I contact the attorney on the
other side. Otherwise, I’ll contact the
person without a lawyer who will quickly
get a lawyer. And then um you know,
depending on the issues, what uh we will
often just try to resolve the matter
without even filing a lawsuit. Sometimes
we will do this by virtue of a
mediation. Sometimes we don’t even need
a mediation. Um a mediation is a
settlement where we we get together
could be virtually. We don’t physically
get together with the other side, but we
have a neutral retired judge who tries
to help both sides or all sides reach an
agreement. And in doing so, um everyone
has to agree. But oftent times with what
we do, we are able to either by virtue
of going to that settlement conference
or maybe even not needing a settlement
conference, we are able to reach an
agreement with the other side resolve
the matter without ever even having to
file a lawsuit. And then that results in
our clients saving tens of thousands of
dollars um for having to go and
litigate. But if we need to litigate,
we’re very capable of doing that. But we
will try to save our clients money and
resolve it without that.

Denver, CO estate planning & probate attorney Andrea Mahoney talks about how her firm helps clients resolve estate disputes short of going to trial.
