the biggest mistake i see there’s two
one is it always has to deal with
improper documentation and a lot of that
can come out of you know the best
intended circumstances right
i have clients or people who will come
to me that had a handshake agreement
perhaps it was over real property maybe
it was over
a trade of some sort and
didn’t fully understand each other you
know it’s not always an argument or
somebody is being a shyster it just
could be that the communication style is
off lending to a different understanding
of what the agreement was and that’s
always i mean that’s where a lot of
lawyers live that’s where a lot of
litigators live unfortunately is those
type of disputes i think the key to
being a good attorney is to get really
to
the root of where the communication
failed
um and and try to resolve it without
litigation because that’s always in the
best interest of the party if you could
you know bring everybody to center from
their sides
the second thing it’s you know the first
would be just not having a written
document that
people could address the second would be
like a really poorly written document
right that
carries with it a different weight than
an oral agreement so
a lot of times
i think people try to avoid or they’re
intimidated by the cost of a law firm
right or the formality that sometimes is
associated with an attorney it could be
a slippery slope for them but i think
you know pennywise pound foolish at
least in this office at black and
whatems
we have a program and i like to deal
with my clients in a way that they’re
not intimidated to call me that they can
ask about a quick question that we could
put a quick document together and get
them off in the right direction for all
these fantastic new endeavors that they
want to get into

Las Vegas, NV business law attorney Tisha R. Black discusses the biggest mistake she sees businesses make when it comes to transactions. She identifies two major mistakes clients often make, both related to documentation. The first stems from informal agreements, often made with the best intentions, that lack clarity. Clients may rely on a handshake, whether over real property, a trade, or another arrangement, and misunderstandings can arise—not necessarily from ill intent, but from differences in communication styles. Many legal disputes arise from these situations. She emphasizes that a skilled attorney works to identify where communication broke down and seeks to resolve issues without litigation whenever possible, as that approach best serves the client’s interests.

The second common mistake involves poorly drafted written agreements. While written documents carry more weight than oral agreements, a vague or incomplete contract can create its own problems. Some clients avoid formal agreements because they are intimidated by the cost or the perceived complexity of working with an attorney. At Black & Wadams, she strives to make clients feel comfortable reaching out with questions. The firm offers programs to draft concise, effective documents quickly, helping clients move forward confidently with their new ventures while avoiding unnecessary disputes.
