In property crimes, like theft and burglary and robbery, there’s two things that I look at right away at the beginning of the case. First is identification. So, it is very important to know how the person was identified. Was it through a post-incident ID? Was it through a photo spread? Was there a lineup? And if none of these things are there, then can we get a lineup? Can we file a motion or ask a judge in court to order a lineup in the case to make sure that we have the right person? The second thing that we look at in every one of these cases is the role of the client in whatever the accusation is. Because, perhaps, the person is just in possession of stolen goods, but they had nothing to do with the burglary or robbery. So, those two topics are the very first threshold things that we look at in all theft-related and property-related crimes.

Philadelphia, PA criminal defense lawyer Brian J. Zeiger talks about the first thing he does when taking on a case involving theft.
