we have a lot of clients who are

inheriting a large sum of money which is

the first time that they’ve really had

money in their life a lot of these

clients are on programs such as Medicaid

or SSI and these are government programs

that will provide medical care that will

give them a study source of income for

their life

and the risk of inheriting a windfall is

that it puts these clients over an asset

threshold for eligibility for continuing

benefits under those programs so it’s

really important that when someone

inherits a windfall that they make sure

to identify any government benefits that

they’re currently on are they on

Medicaid are they on SSI if they’re on

either of those we can protect their

windfall inheritance by transferring it

into a Special Needs Trust in that way

they can keep their windfall and they

can keep their government benefits at

the same time

Chicago, IL estate planning & probate attorney SJ Chapman talks about special needs trusts and how they are used when there is a windfall. She explains that many clients come to us who are inheriting a large sum of money, often for the first time in their lives. Many of these clients are already receiving government benefits such as Medicaid or SSI, which provide medical care and a stable source of income. The problem with inheriting a windfall is that it can put these clients over the asset threshold for continued eligibility for these programs. It is crucial for clients who inherit a windfall to identify any government benefits they are currently receiving, such as Medicaid or SSI. If they are on either of these programs, we can protect their windfall by transferring it into a Special Needs Trust. This allows them to keep their inheritance and their government benefits simultaneously.
