What’s the biggest challenge you face in defending charges of possession of child pornography?

Most cases of child pornography are done
with computer searches, with computer uh
raids on people’s homes, taking their
devices because the government, the FBI,
usually sometimes the local police have
been able to determine whether through a
um a cooperating witness or through
their own participation on these
websites to catch people in stings have
determined that someone is downloading
and saving
uh information or photos of children uh
of illegal children photos. What they
use a lot of is they use IP addresses,
internet internet addresses of people’s
computers. They then they can narrow
down whether it was a computer at a
house, a computer in the in a
neighborhood and they can determine who
the internet service provider is and
really hone in on who it is. That makes
it really difficult because the only
real defense there is that someone else
did it. And when you have a laptop in
your house and that you use that’s
logged into all your accounts, it’s
extremely difficult to say, “Oh, well,
my uncle came over or my brother came
over the other day and he was using my
computer. I don’t know what he did with
it.” So, it’s very difficult to overcome
usually federal cases when they have
that information. They have enough to
convict you before you’re even indicted.
