If a worker’s injured on the job, he or she is entitled first of all, to a safe place to work, safe equipment, and that’s what the Federal Employers Liability Act tells the railroad they must provide to you. And if they fail to do that and you’re injured on defective equipment or the negligence of a co-employee or a manager, you have the right to recover for your losses. And your losses can include past and future wage loss or loss of earning capacity, loss of fringe benefits be they medical expenses, medical insurance in the future. It can also be pain and suffering and mental anguish both physical pain an even emotional pain. And sometimes there’s severe emotional pain of someone has PTSD or other emotional injuries.
