with complex assets often times you have
to have an expert uh to Value them I
have a people that I use regularly or
you know there certain experts you look
for to determine uh what that value is
and then you usually assign a value and
either they can receive half if it’s
able to be divided or there’s another
asset that offsets that value um for the
client whose name is not on the asset
some sometimes assets cannot be divided
um it depends on the terms of for
example a partnership agreement or
bylaws of Corporation something like
that that the interest cannot be divided
between spouses or between you know with
anybody and in that case what we’ll
often do is um we will have the asset
held in constructive trust by the party
whose name is on the asset for the other
party so that that person it is an
ownership interest and person who
actually owns it has to hold it in trust
and do the right thing by their spouse
or their other their
partner

Boston, MA family law attorney Terri Partridge talks about the issues that commonly arise in the division of complex property in MA divorces. In handling complex assets, professionals are often engaged to determine their value, and she consistently collaborates with specialized experts in this field. Once the value is established, the distribution can vary. If the asset is divisible, the client may receive half, or another asset could be assigned to offset the value for the client not named on the asset.
