Well, if you have a probate asset, which
is an asset solely in your name, no
co-owner, no designated beneficiary, and
then if that will will dictate how that
asset is to be distributed. If you don’t
have a will, then we have what we call
intestasy laws that tell us, we lawyers
and the judges, how an asset will be um
assets will be dispersed. So if you want
to control how your assets are going to
be distributed, then you would execute a
will to do so.
Denver, CO estate planning & probate attorney Andrea Mahoney talks about how having a will affects the probate process.
