Probably the hottest area that I get the most questions about people calling up and saying, “How can I protect this?” is in the software industry. People doing apps for mobile phones, people doing large websites. That area of the law has gone under a significant change, going back to 2014, when the Supreme Court limited how you could protect software patents. While I still get lots and lots of calls of trying to protect software, in a lot of cases, there’s really not much that can be done. It’s frustrating for the developers of the software that had to rely on copyrights alone.

But it’s still a very happening area. I see a lot of clients coming in, trying to protect those ideas as best we can. I have one partner in our firm, Clark Jablon, who specializes in that area, and he handles nothing but that. But it’s difficult. It’s a real challenge for companies that are trying to develop software platforms to get out and protect them. PTO is really cut back on that, although the pendulum’s starting to swing back, but it hasn’t come back very far.
