The reality is that as the baby boomer
generation has aged and as real property
values have increased exponentially,
especially in California, that what in
the past might have been a small family
estate, can now be worth many millions
of dollars. And so in a way that no one
ever envisioned uh you know financial
elder abuse is becoming more prevalent,
undue influence is becoming more
prevalent and as a result trust and
estate litigation is becoming far more
common. 30 years ago when some of my
mentors began doing this it was quite
narrow area of law. But now
unfortunately
the the value of estates and and the
rise of the elderly population means
that inevitably there will be disputes
over trusts and estates that might in
the past have gone forward smoothly.

Historically, trusts and estates constituted a relatively narrow field of law. However, as estate values have grown and the elderly population has expanded, disputes that might once have been resolved informally or without conflict now frequently escalate into contested litigation. This trend reflects both the heightened financial incentives for heirs and beneficiaries, as well as the increased vulnerability of elderly individuals to exploitation in the final years of life.
