So many years ago, I represented a
client who prior to my involvement was
convicted at of at trial of murder. The
incident stemmed from a pickup
basketball game where there was a fight.
Uh he hit the the victim and the victim
fell backwards, hit his head, and died.
It went to trial and the what convicted
the client was medical testimony that
the injury could not have been caused by
simply the victim falling back and that
my client had actually attempted to
strangle and choke the the victim. By
the time that I was involved, the judge
had granted a new trial and so we
returned to trial. Uh, and I was able to
bring in a reputable forensic medical
examiner who testified that the injury
was caused by a fall. Uh, that the
injury could not have been caused by
anything else. uh refuted the the prior
testimony that had been presented at the
first trial and was so effective that
the witness from the first trial, the
medical witness from the first trial
actually recanted and supported our
theory, which was that this was an
accident caused by a fall and my client
was found not guilty.
