So, this was a case where a little 16-month-old little girl is at a daycare, and the daycare worker slams
the little 16-month-old girl’s head into a door frame four times in one day, and it’s all on video. And during that day,
she is um this little girl can’t even communicate, right? I mean, she she can’t articulate what’s even going on because she’s 16 months old. The woman
is eating her food. When she changes a diaper, she doesn’t wa, you know, clean the private parts, nothing. Just throws another diaper on. Never washes her
hands, nothing. Anyway, this little girl is picked up at the end of the day.
She’s sitting in the middle of the playground. Her hands are on her head because she has an occipital skull fracture. And she can’t even say that.
She can’t say what’s happening. She’s crying cra like crazy. parents come and pick up the child and they tell the
parents, “Oh, she just had a bad day and they never tell the parents what happened. They never tell any other parents what happened.” The woman is
ultimately it’s investigated. Obviously, Dyus gets involved. The woman goes to jail. My case was against the daycare
center for negligently hiring this woman. She was a she had four DWI when they hired her. The only way she
could get to work was by blowing into an interlock device on her car to make sure she wasn’t intoxicated. Yet, they trusted her to watch children. And they
never supervised her. They never She’s on camera all day. They could have intervened any time. They never did. And
they never told the parents. So, the case was successful. It settled for a lot of money, uh, multiple seven
figures. And the money re the parents were devastated. The wife had to quit her job. She could never put that child
in a daycare again. So she just quit her job to stay home to take care of her her baby. And it put a terrible financial
strain on the parents. The father was a school teacher. And they were also psychologically affected as well because
you trust your child with the person who watches your child all day at the daycare. And that trust was violated. So
they had their issues and we really really changed the life of that family.
The child is okay. Thank God she’s good.
The woman was put away to jail and the daycare paid a lot of money and these people now and I funded an annuity for
this child. This child will have her college paid for in her life. And I was thinking about it. the annuity will
continue on probably long beyond me being on this planet. So, I actually change someone’s I It’s almost like I’m
reaching out to help somebody and I won’t even be here when this child is receiving a lot of this money from the annuity, but we change the life of the
family. The the child and the family can move out of that town if they want. They could get a house that the kid can go go to college and she’ll have plenty of
money to take care of her family someday. All because of what happened when she was 16 months old.

Parsippany, NJ personal injury attorney Christopher Masmunno talks about a memorable daycare case he handled. He shares a case involving a 16-month-old child who suffered serious injuries while attending a daycare center. He explains that video footage showed a daycare worker repeatedly striking the child’s head against a door frame and neglecting basic caregiving responsibilities throughout the day. When the parents picked up their daughter, they were not informed about the incident despite the child having sustained a skull fracture and showing signs of distress.
He goes on to explain that the case focused on the daycare center’s negligence in hiring and supervising the employee. According to the investigation, the worker had a history of multiple driving-related offenses, yet was entrusted with caring for children and was not adequately monitored despite being on camera throughout the day. The matter ultimately led to criminal consequences for the employee and a successful civil claim against the daycare facility.
He notes that the case resulted in a substantial settlement that helped ease the significant financial and emotional burdens placed on the family. The child’s mother left her job to care for her daughter, and both parents struggled with the betrayal of trust and the trauma of the incident. He concludes by explaining that part of the recovery was structured through an annuity designed to provide long-term financial support for the child, including future educational opportunities, helping secure a more stable future for the family.
