High conflict cases in divorce, in a mediation setting, aren’t any different than other types of divorce cases if both parties are motivated – motivated to avoid costly litigation, and motivated to settle. In high conflict cases, the mediation technique that we employ is shuttle diplomacy, where the mediator separates the parties and then goes back and forth with the messages, and filters the hostility out of the mediation equation.
