insurance defense is
an incredibly interesting area of law
and one that
i don’t think people necessarily
appreciate its
complexities and diversities i say that
because
as a threshold the insurance defense
practice
for a lawyer you’re a servant to two
masters
you have the insurance company who
insures the insured
and is oftentimes the entity with whom
we have relationships
with direct relationships and you also
have the client the insured
someone who’s been sued in a lawsuit
that
we are hired to represent so in reality
we have
two clients with overlapping
interests but differing approaches and
differing concerns
related to that is insurance defense
whether it’s general liability or
professional negligence or the myriad
other areas
comes from a variety of businesses and
and areas so while the law for example
on-premises liability
is fairly consistent with vagaries and
changes
through appellate opinions and new laws
you get those questions coming from
condominium associations
from construction sites from sports and
entertainment arenas
from a variety of places where as a
insurance defense lawyer we not only
have to be able to
apply the law to those differing
arenas and contacts but we also have to
become
quick studies and learn about the
different areas
in order to best represent our clients
and it’s incredibly challenging
but it’s incredibly rewarding and the
great thing about our firm is that we
have the
experience the capabilities and desire
to meet those needs and meet that
standard
you

Baltimore, MD commercial litigation attorney Jonathan D. Nelson shares his firm’s approach to handling insurance defense cases. He considers insurance defense to be an exceptionally engaging area of law, one whose complexities and diversity are often underappreciated. In this practice, a lawyer serves two “clients”: the insurance company, which provides coverage and maintains direct relationships with the firm, and the insured, the individual or entity facing a lawsuit. While these clients share overlapping interests, they often have differing priorities and concerns, requiring careful navigation to represent both effectively.

Insurance defense spans a wide range of industries and legal issues. For example, while the law governing premises liability may be fairly consistent, questions arise in a variety of contexts—from condominium associations and construction sites to sports and entertainment venues. An effective insurance defense attorney must not only apply the law across these diverse arenas but also quickly become familiar with the unique operational and risk considerations of each client’s business.

He finds this combination of legal analysis, strategic problem-solving, and industry-specific learning both challenging and rewarding. At his firm, Ferguson, Schetelich & Bellew, P.A., they combine extensive experience, technical capability, and dedication to meet these complex demands, ensuring that each client receives knowledgeable and effective representation.
