For us to be successful in these cases, it really has to be a situation where we can prove it is an accident. To be successful on the civil side, which is what we do, you have to have insurance coverage, and insurance only covers accidents. So putting together the facts so that they line up where you do have coverage for the shooting is very important. In situations where somebody was intentionally shot, that’s not a case for us. That is more of a criminal matter, and that’s between the district attorney and the criminal courts.
Houston, TX personal injury lawyer Shane Kadlec talks about the biggest challenges of gun accident cases. He shares that for him, success in these cases depends on being able to prove that the incident was truly an accident. In situations where someone was intentionally shot, those are not cases for him; such matters fall under the criminal system and are handled by the district attorney and the criminal courts.
