00:04
the use of the wires in a scheme to
00:05
defraud
00:06
that’s the wire fraud statute the mail
00:09
fraud statute is use of the mails in a
00:11
scheme through the front
00:12
so the basic idea with wire or mail
00:16
is that the wire transmission or the
00:19
mailing
00:20
confer federal jurisdiction that allows
00:23
them to prosecute
00:25
the underlying fraud scheme and that’s
00:27
what it is
00:28
so for example in a in a mail fraud case
00:31
they might prove up
00:33
a fraud that someone defrauded
00:36
a company or somebody else and they
00:38
would prove a mailing
00:39
and that’s the way that the federal
00:41
court has jurisdiction
00:43
the mailing doesn’t really have to have
00:45
anything to do with the fraud
00:47
it doesn’t have to be done by the person
00:49
accused of the fraud
00:50
this just has to be something that
00:52
occurred in the course of
00:54
events that confers upon the federal
00:56
court
00:57
jurisdiction that’s all it is
01:04
well i tried my first mail fraud case as
01:08
co-counsel with
01:10
ron meshbesher in november of 1984
01:13
and i’ve tried many uh wire and mail
01:16
fraud
01:17
cases in the 36 years since then
01:21
and handled many more it’s a very common
01:23
uh
01:24
federal crime it’s a crime that
01:27
prosecutors like to charge because the
01:30
statutes are easy to work with
01:32
and the juries can understand mailing
01:35
something or
01:36
sending an email or something like that
01:39
so i do lots and lots of federal
01:40
white-collar stuff and
01:42
those are two of the generally used
01:44
statutes the other one
01:46
is bank fraud the prosecutors like bank
01:48
fraud because it has a 10-year statute
01:50
of limitations
01:51
as opposed to five years for mail and
01:53
wire fraud so
01:55
it allows them to reach back further so
