Premarital agreements, we don’t deal with that very often, quite frankly, because usually they’re already married when they see us. If we see people that consult with us or their kids consult with us if you’re going into a marriage and you’ve got kids from another marriage it’s real important. If you have your own estate that you want to keep separate and apart from that of your spouse that’s important. Our perspective on that is a different one than premarital that talks about what’s the support going to be. We don’t deal with that or with child custody or things like that it’s just not something we see.

Phoenix, AZ estate planning attorney Mark A. Bregman talks about his experience with premarital agreements. He notes that premarital agreements are not a significant part of his practice, as most clients who seek his services are already married. However, when individuals—or their children—consult with him prior to marriage, premarital planning can be very important. This is especially true in situations where one party has children from a prior marriage or wishes to preserve a separate estate apart from a new spouse.

His focus in this area differs from premarital agreements that address issues such as spousal support or child custody, which he does not handle. Instead, his role centers on estate-related planning to ensure assets are properly protected and managed in light of marriage and blended family considerations.
