The issues generally relate to valuation. What’s the property worth?
What uses could be made of it under zoning law or under changes in zoning law that were reasonably available to
the property owner at the date of value, which is the date the eminent domain case starts. So trying to determine what
the reasonable changes in zoning could be that might impact the value of the property to make it more valuable uh or
perhaps less valuable are all factors that have to be considered, analyzed, and the appraiser takes that into account in determining what’s called the
highest and best use of the property, which is the most valuable use the property could be put in a particular situation.
