the biggest challenge that we Face these
days is fentanyl um because fentanyl is
often sold as a standalone drug but it
is also sold very often as an imitation
drug they will create fentanyl pills
that will be stamped and formed to look
like pills of something else uh to try
to throw law enforcement off the scent
there are many cases of of drug crimes
where you know for example just selling
marijuana and they tested at the lab and
L whole there’s fentanyl in it and I
think everybody just Knows by now that
fentanyl is extraordinarily dangerous
and that one dose can kill a person it
can also not and very often much more
often than not doesn’t kill somebody uh
but the fact that it does and and very
often when it does it’s a very
high-profile situation so no prosecutor
wants to be known as somebody who’s soft
on that because usually the kinds of
people that get taken from us with those
sorts of overdoses are not the kinds of
people um that you would expect you know
we’re talking about high school kids
overdosing when they think they’re
taking Aderall and turns out there was
fentanyl in it and that’s what killed
them you know despite the sort of
progressive nature of of law enforcement
these days or at least prosecutions
these days fentel still strikes a a
tough note and if you’re caught with
fentanyl especially Distributing
significant amounts of it they are going
to come down really hard on you
um so that’s the biggest thing is you
know before it was always you know all
the tough drugs were kind of lumped
together and sort of treated the same
but now that fentanyl is really kind of
emerged uh and it’s so prolific it is so
dangerous um they they really do treat
fentanyl cases very differently than any
other case that we have out there

Manassas, VA criminal defense attorney Steve Duckett talks about the prosecutorial trends faced in drug cases. He explains that one of the greatest challenges in criminal defense today is fentanyl. While it is often sold as a standalone drug, fentanyl is frequently disguised as other substances—pills stamped to resemble medications such as Adderall—to evade detection by law enforcement. In many cases, drugs like marijuana are tested in a lab only to reveal the presence of fentanyl, a substance so potent that a single dose can be fatal.

Although not every exposure results in death, the high-profile nature of fentanyl overdoses creates intense pressure on prosecutors, who are reluctant to be perceived as lenient. Tragically, victims often include unsuspecting individuals, such as teenagers, who consume what they believe to be another substance.

Because of its lethality and widespread prevalence, law enforcement and prosecutors treat fentanyl cases more severely than other drug offenses. Significant distribution charges carry especially harsh consequences, reflecting the serious risks associated with this drug. Fentanyl has fundamentally changed the landscape of drug prosecution, requiring a distinct and careful approach in defense.
