Colorado Springs, CO criminal defense attorney Alexis Austin Litle talks about what you should do if you’re arrested. She emphasizes that her primary advice to anyone who is arrested is to remain silent. Respectfully, she stresses that one should not say anything, as attempts to explain oneself or justify actions to law enforcement can inadvertently create additional legal complications. Even if the individual is innocent, the safest course is to exercise the right to remain silent. This should not be mistaken for rudeness or uncooperativeness; rather, it is a protective measure to safeguard one’s legal rights.
She advises that individuals being arrested have the right to ask why they are being detained and to understand the charges against them. They also have the right to request an attorney. It is crucial that this request be made unequivocally—phrases like “I think I need an attorney” are insufficient. Instead, one must clearly state, “I want to speak with my attorney,” and then refrain from answering any further questions.
The only information police may require is one’s legal name and, for identification purposes, date of birth. Beyond that, no other statements should be made. She stresses the importance of immediately contacting one’s attorney, such as the Right Law Group, to receive guidance on protecting oneself during this process. Her two most important recommendations are clear: remain silent completely, and wait for legal counsel before responding to any questions.
