One of the cases that I tried to verdict, which was really interesting was a case called McKenzie v. Icom. It was a personal injury case on a construction site. Mr. McKenzie who was a very large man, was known as Big Mac, and he was out on a second floor balcony trying to screw part of the building back together when his power screw gun hit him in the head causing him to fall down two stories and land on his head. He suffered severe injuries to the point where they actually put a toe tag on him when he was presumed dead in the hospital but he came back to life and was a plaintiff. He sued my client contending that my client was the general contractor on the site and owed him a duty of care that was breached when he went out on the balcony. The jury, believe it or not, found that Mr. McKenzie shouldn’t have been on the balcony with a screw gun that ended up hitting him on the head and rendered a complete defense verdict.
