I was on a case today where the father could not understand why he had to pay child support during the summer month when he had visitation with the kids all summer or all the month of July. And child support is annualized and then paid monthly and so it’s based on the annual income of the obligor. Normally, while it’s a factor the obligee, the person receiving support their income is not really relevant. It’s discoverable but it’s not part of the formula. And so this is how I remember it, one kid 20 percent, two kids 25, and you go 20, 25, 30, 35, and you keep adding five percent for each kid. And it’s based on the obligor’s net income and right now in 2018; we have a cap of $8,550.00 net. So that’s roughly $150,000.00 a year. So people making over $150,000.00 a year pay the same, you know if you’re making $300,000.00 a year under the formula you pay the same as somebody making $150,000.00 a year. Now there’s lot of exceptions I’ve done a lot of case where I’ve sought and received above guideline child support and you need a skilled lawyer to do that. It’s not easy. There’s case law that supports it and you really have to prove your facts to get that.
