In cauda equina litigation the fight over what we call causation.
Did the negligence actually cause the harm is really the horse race in these cases.
And the way we prove it is we use expert witnesses, primarily neurosurgeons, but there can be other medical um experts
that we use. But those medical experts will look at the symptoms that the
person had at the time when they could have had a decompression surgery when a surgeon could have gone in and fixed the
problem. And we look at then by the time the surgery does happen, what’s the condition of the patient? the before and
the after. And that really along with using expert witnesses kind of answers the question on causation.
