a memorable
00:05
motor vehicle accident case that i
00:08
handled
00:09
involved a pedestrian who was
00:12
run over by a car i represented the
00:15
pedestrian and he was crossing
00:17
the street um outside of a crosswalk
00:20
and so the insurance company immediately
00:22
denied the claim
00:24
when i went to visit the pedestrian
00:27
my client at the when he was getting
00:30
rehabilitation at a nursing home for his
00:32
injuries
00:32
i visited him and i quickly realized
00:34
that he
00:36
is unable to communicate well he has a
00:38
disability most of his answers
00:40
would ten would just be yes the word yes
00:43
and you couldn’t really explain what
00:45
happened
00:46
and so i knew that if if the only
00:47
version of events would be
00:49
what the defendant driver says that’s a
00:51
big problem
00:52
we’re not we’re not going to get the
00:54
full story so i went out
00:56
to the scene of the accident i looked
00:58
for
00:59
any again any footage is there something
01:02
is there a business nearby
01:04
so i found a bar really close to where
01:06
the collision occurred
01:07
it had a camera pointing to almost
01:09
exactly where the collision occurred
01:11
and i called them and they said they’ve
01:14
deleted
01:15
the footage and i was unfortunate and i
01:18
later found out that the
01:20
the driver of the car actually worked at
01:22
that bar
01:24
and so i thought that was suspicious and
01:26
then i realized well if he’s
01:28
leaving the bar then he wasn’t on the
01:32
main road that the client was
01:35
crossing and therefore um it’s not
01:38
my client’s fault so i needed proof of
01:41
that
01:42
so i obtained the body worn camera
01:44
footage from the
01:45
police officers who responded and that
01:47
was incredibly helpful because i could
01:49
see
01:50
on the footage where my client was laid
01:53
out on the ground how close was he to
01:55
the
01:55
to the sidewalk statements made by the
01:58
the driver that that i wasn’t looking
02:01
when i turned
02:03
this direction i didn’t look in that
02:04
direction and i was coming out of here
02:06
and so the insurance company went from
02:09
completely denying the
02:11
the claim to paying hundreds of
02:13
thousands of dollars to resolve the case
02:16
without litigation

Baltimore, MD personal injury lawyer Ruslan Kondratyuk shares the story of a memorable motor vehicle case he handled. He recalls one of his most memorable motor vehicle accident cases involved a pedestrian who was run over by a car. He represented the pedestrian, who had been crossing the street outside of a crosswalk. Because of that, the insurance company immediately denied the claim, insisting the pedestrian was at fault.

When he visited his client at the nursing home during rehabilitation, he quickly realized the man had a communication disability—most of his responses were limited to the word “yes.” It was clear that relying solely on the driver’s account would not tell the full story. Determined to uncover the truth, he went to the scene of the accident himself to look for any possible video evidence.

Nearby, he discovered a bar with a camera that faced directly toward the crash site. When he contacted them, he was told the footage had already been deleted. Later, he learned that the driver actually worked at that bar—a fact that immediately raised suspicions. He reasoned that if the driver had been leaving the bar, then he wasn’t traveling on the main road where his client was crossing, which could mean the driver—not the pedestrian—was at fault.

To substantiate this, he obtained body-worn camera footage from the police officers who responded to the scene. The video provided crucial details: it showed where the client had fallen, how close he was to the sidewalk, and even captured the driver admitting, “I wasn’t looking when I turned.”

Thanks to this evidence, the insurance company reversed its position—shifting from completely denying liability to paying hundreds of thousands of dollars to resolve the case without litigation.
