Austin, TX personal injury attorney Scott Hendler shares the story of a memorable motor vehicle case he handled. He recalls one of the most memorable and significant cases in his career involved a horrific car crash caused by a drunk driver. The driver, excessively intoxicated after leaving an upscale bar and grill, slammed his F-150 pickup truck into the rear of a family of four stopped at a traffic light, traveling at roughly 60 miles per hour. Tragically, both teenage daughters in the back seat were killed, along with the family’s pet dachshund, while the mother and father in the front seat were severely injured.
The lawsuit was complex, involving multiple defendants: the driver, the truck’s owner who had been with him, the bar and grill where he had been drinking, and a nearby restaurant he had visited beforehand. There were multiple layers of insurance and numerous theories of liability to navigate, alongside a family devastated by the sudden loss of their two youngest daughters—one en route to the Air Force Academy, the other to the University of New Mexico. Both were star basketball players whose lives were cut tragically short by the actions of a habitual drunk driver and the overserving by restaurant staff who had clearly recognized his intoxication.
The result of the lawsuit produced a substantial recovery for the family and established a significant charitable foundation aimed at reducing, if not eradicating, drunk driving in their community. Additionally, the restaurant changed its business practices, implementing a strict three-drink limit per patron and requiring food with all alcoholic beverages. The day the settlement was reached, he recalls seeing twin rainbows in the sky outside the office window—a deeply moving moment that underscored the significance of the case and the change it inspired.
