The most surprising thing that the public will not be aware
of really is exemplified when we’re in litigation. And that very often
the defense side, the insurance side of the case will try to shepherd people making
claims of brain injury or concussion to health care providers that routinely testify for the defense.
And they’re not honest. They want to embrace the science that existed 30 or
40 years ago and they’re not embracing the science that’s replete in all of the
compelling medical journals now. I mean, it’s really been an eyeopener.
Um, and and I’ve it’s something that I’ve watched and uh monitored very closely over the years.

Stamford, CT personal injury attorney Stewart Casper talks about the most surprising thing about brain injury cases. He points out that one aspect of brain injury litigation that many people may not realize is the role that defense-retained medical experts can play in evaluating concussion and traumatic brain injury claims. According to him, insurance companies and defense teams often rely on healthcare providers who regularly testify on their behalf, and some may base their opinions on older theories of brain injury rather than the more recent scientific research reflected in current medical literature. He notes that this issue has been particularly revealing to him over the years and remains an area he continues to follow closely as brain injury science continues to evolve.
