So when defending an assault charge, the hard part about it is that it really is just he said/she said. So in Texas, you don’t have to have any sort of bruise. You don’t have to have a cut. The prosecutors don’t have to have any physical evidence to show that someone was hurt. Simply saying, “They caused me pain,” is enough in Texas to convict someone. And that is the biggest hurdle to get over in a courtroom is proving that someone wasn’t hurt or that they weren’t caused pain since they don’t have to show any sort of evidence of a bruise or cut or anything.
