Because you can get a modification of spousal maintenance at any time upon a showing of a change in circumstances, you need to be thoughtful about when you seek that change. The laws in the state of Minnesota allow you to get an increase in maintenance based upon something called a cost of living adjustment. So, as provided your spouse who’s paying spousal maintenance has an increase in their income that matches the cost of living adjustment, your spousal maintenance can go up without every two years without you having to bring a motion. However, if you think there’s been a greater increase in their income to warrant a greater need for spousal maintenance, or if your income has decreased, you can bring that motion at any time if you think it’s the right decision to make.
