00:04
my most memorable case is very easy
00:07
because it had a lot of components i was
00:10
asked to come in for a small luxury
00:12
cruise line they were having a problem
00:15
with their potted propulsion system
00:18
it was failing
00:19
and it was failing on several of their
00:21
ships
00:22
and
00:23
that is a huge expense for a cruise line
00:26
they had already had other council that
00:28
had filed suit against the manufacturers
00:31
of this system but it was clear that
00:35
that lawsuit was not going to succeed so
00:38
i had to step in
00:40
and with a big team we
00:43
turned the case around
00:44
we
00:46
then started having very meaningful
00:48
discussions with the manufacturer
00:51
and this was very important because the
00:53
manufacturer was part of a consortium so
00:56
there were multiple companies working
00:58
together to create the system
01:00
and they were no longer working together
01:02
and so just filing a lawsuit and asking
01:04
for a bucket of money was not going to
01:07
fix our clients problem
01:09
so we really worked
01:12
very hard with the ceo of the cruise
01:14
line
01:16
the various operating people within the
01:19
cruise line and the manufacturer to
01:21
create
01:22
a system where we got the bat band back
01:25
together again which were the different
01:27
separate manufacturers for this
01:29
component
01:30
we got them together we were able to
01:33
have an excellent confidential
01:36
settlement with them
01:37
monetarily but in addition and more
01:39
importantly to have a system in place so
01:42
that they would continue to do whatever
01:44
repairs were necessary
01:46
to the system for the life of that
01:49
cruise lines vessels

Miami, FL admiralty & maritime attorney Michelle Otero Valdés shares the story of the most memorable case she’s handled in her 27 years in the industry. She recalls her most memorable case with ease because it involved so many complex components. She was asked to assist a small luxury cruise line that was experiencing repeated failures in their pod propulsion system across several of their ships—a significant expense for the company. Previous counsel had already filed a lawsuit against the system’s manufacturers, but it was clear that the case would not succeed.

Stepping in with a large team, she helped turn the case around. They initiated meaningful discussions with the manufacturer, which was part of a consortium of multiple companies that were no longer collaborating effectively. Simply filing a lawsuit and seeking damages would not resolve the client’s problem.

She worked closely with the CEO of the cruise line, operational staff, and the manufacturers to reestablish collaboration among the consortium members. The result was an excellent confidential settlement that included monetary compensation, but more importantly, established a system to ensure the necessary repairs would continue for the life of the cruise line’s vessels.
