No, no, no. You are not supposed to collect unemployment and Workers’ Compensation benefits at the same time. But this lends itself to an important question. The word is called an intervener. If you receive benefits on a claim, whether the claim was admitted or denied, where somebody else or some other group has paid benefits, the lawyers or even you, as the employee, have a duty to put them on notice so they get involved in the claim. So unemployment’s a big one because when people are off and the claim is denied or people don’t get benefits yet, they will go collect unemployment. So we have to put unemployment on notice. And they have a right to be paid back, or they can be negotiated with, depending on the merits of their claim. But the answer to that question is you are not supposed to collect both at the same time.

Minneapolis workers’ compensation attorney, Dean Salita, explains why you’re not supposed to collect unemployment and workers’ compensation benefits at the same time.
